A Resident Return Visa enables you to travel in and out of Australia as many times as you want until the travel validity expires.

    In order to be eligible for a Resident Return visa you must be either an Australian permanent resident, a former Australian permanent resident whose last permanent visa was not cancelled, or a former Australian citizen who lost or renounced Australian citizenship. Unfortunately, if you are not an Australian permanent resident, you are cannot use our online service offering.

    Residence requirement for the visa applicant

    In order to be eligible for a Resident Return visa with a validity period of 5 years (from the date of visa grant), you must meet the so-called residence requirement. This means that you must have been physically present in Australia for at least 730 days in the 5-year-period prior to your application. These 730 days do not have to be consecutive but can be accumulated over the last 5 years. 

    Have you been present in Australia as a permanent resident or Australian citizen for periods totalling at least 2 years in the last 5 years? * Required

     If you do not meet the residency requirement of having been present in Australia for a period totalling at least 2 years in the last 5 years, you may still be eligible for a Resident Return visa if you can demonstrate substantial ties which are of benefit to Australia. However, please note that our online service offering is only available for applicants who do meet the residency requirement.

    Character requirements for the visa applicant

    Have you ever been convicted of an offence in any country or have you been charged with any offence that is currently awaiting legal action? This includes any suspended sentences or convictions, also those which have already been removed from official records. * Required

    Since details of convictions and offences must be disclosed in the visa application, these cases can be more complex depending and require therefore a thorough individual assessment and personal consultation.

            National identity cards

            For applicants from India, the preferred identification for Indian nationals is the Aadhaar card. As the Aadhaar card does not have an expiry date, the applicant should leave the ‘Expiry Date’ field blank. If the applicant does not have an Aadhaar card, they may enter their PAN card, drivers licence, or voter ID numbers under Other identity documents section on the form.
            All applicants from Indonesia must provide their valid and current Kartu Tanda Penduduk (KTP) identity card details, including their Nomor Induk Kependudukan number.               Character questions and criminal convictions

              This section contains questions concerning criminal charges, convictions and service in police or military forces. Please read all of the following questions carefully and answer them truthfully.

              Criminal offences, charges and convictions have to be disclosed in a visa application. This includes, for example, traffic offences that went to court, spent convictions and suspended sentences.The Department may request a National Police Check if their records indicate any previous convictions or charges or if it is deemed relevant for assessment of the application. Not disclosing criminal charges and convictions as well as giving false, incomplete or misleading information in a visa application is a serious offence and can result in a visa refusal or even a cancellation, depending on the case.

              If you are unsure whether or not there are any convictions or charges recorded, we strongly recommend applying for an Australian Federal Police Check first. Addressing character related issues and undisclosed conviction and/or charges is not part of this online service offering. So if in doubt whether or not something has to be disclosed, please contact us to clarify this matter before booking our service as we may terminate the contract and cease representation in case of undisclosed character related aspects.

                  SERVICE AGREEMENT 

                  Application for an Australian Resident Return (subclass 155) visa 

                  1. Parties to the contract:

                  2. Scope of service 

                  2.1 Visapath will provide the following services:

                  • Immigration advice and lodgement services relating to the application for a Resident Return visa
                  • Review of the information and documents provided in the questionnaire
                  • Check of the relevant visa eligibility criteria
                  • If required: Consultation with the client regarding the information and evidence provided and advice on additional documents and data 
                  • Submission of a visa application for a Resident Return visa to the Australian Department of Home Affairs. This is usually done within two working days after the client has provided all the necessary documents and information
                  • If required: Handling of any queries and requests from the Department of Home Affairs in coordination and cooperation with the client 
                  • Payment of the Visa Application Charge of A$475 to the Department of Home Affairs
                  • Forwarding of the visa or the decision on the application to the client

                  2.2 Additional services without charges:

                  • After visa grant free passport update during the validity period of the Resident Return visa

                  3. Professional fees and disbursements

                  3.1 The fixed professional fee of covers the completion of the services provided by Visapath as listed in section 2.1 as well as the Visa Application Charge payable to the Department of Home Affairs. 

                  3.2 The Visa Application Charge will be paid by Visapath to the Department of Home Affairs when the visa application is submitted on behalf of the client. The Visa Application Charge is usually not refunded if an application is withdrawn or rejected.

                  3.3 If the visa application is not submitted, the professional fee is reduced to A$165.

                  3.4 In most cases, there are no additional costs apart from the Visa Application Charge included in the fixed fee. In individual cases, however, it may be necessary to submit additional documents. Costs for obtaining and translating these documents are not included in the fixed fee as per section 3.1. The client can either organise the translation of these documents themselves or request Visapath to organise translations by a NAATI-certified translator on their behalf. In that case, the price per page for the translation of a standard document from a common language (including German, French, Spanish and Italian) into English is A$ 70.00 (plus GST, if applicable). An individual quote can be provided for documents in other languages.

                  3.5 In some cases, a medical examination may be required. The costs for this medical examination have to be paid by the client.

                  3.6 Payment:

                  a) The professional fee as per section 3.1 will be invoiced when the visa application is submitted.

                  b) If the visa application is not submitted because the client terminates this agreement, the fees set out in section 3.3 are due upon Visapath's confirmation of the termination.

                  c) If the application cannot be submitted because the client does not meet the requirements, the fee set out in section 3.3 is due with the customer being informed of the reasons.

                  3.7 The client has selected payment by credit card or PayPal. We will reserve the amount of on your card or PayPal account (“Pre-Autorisation”), but will not finally charge it until the fee is due in accordance with section 3.6.

                  3.8 Visapath will not start processing the order until the full amount of the advance payment in accordance with section 3.7 has been credited to the designated account. Visapath is not obliged to provide services in accordance with section 2 as long as the advance payment has not been received in full. The visa application is also only submitted if the required reservation is still valid or has been successfully renewed. Visapath is not obliged to provide services in accordance with Section 2 if the agreed fee is not guaranteed in full by a valid reservation using the chosen payment method.

                  4. Migration Agents and authorisation

                  4.1 The dedicated migration agents for services provided under this agreement are:

                  • Christine Dax (MARN1802924)
                  • Juergen Mader (MARN 2117672) 

                  4.2 The client authorises all Registered Migration Agents associated with Visapath to submit a visa application for a Resident Return visa on behalf of the client and to communicate on behalf of the client with the relevant Australian authorities regarding that application.

                  4.3 The client can contact Visapath and the migration agents responsible for submitting the application via email at support@visapath.com.au. 

                  5. Completion of service and termination of the contract

                  5.1 This service is completed with the decision of the Australian authorities on the visa application. Consulting service and advice regarding options for appealing a decision or handling an appeal is not part of this agreement. 

                  5.2 The client can terminate the contract at any time.

                  5.3 If the client does not meet the requirements for the visa and these cannot be established either, Visapath will explain the reasons for this in writing to the client. The order is completed with this explanation.

                  5.4 A termination of this contract by Visapath is possible under the following circumstances: 

                  • The client has provided false or misleading information or submitted bogus or misleading documents.
                  • The client has not disclosed character related aspects in the questionnaire (i.e. criminal charges and convictions in the section ‘Character questions and criminal convictions’ in the online questionnaire) and there is a request for further information by the Department of Home Affairs due to these matter.
                  • The client cannot be contacted for a period of more than one month despite repeated attempts and after Visapath has informed the client of the intended termination of the contract and with a deadline of two weeks.
                  • The client has not provided the information or documents required within a period of two months after the initial request and Visapath has informed the client of the intended termination of the contract with a deadline of two weeks.
                  • An irresolvable conflict of interest has arisen.
                  • Continuing the service is no longer reasonably possible for Visapath due to other reasons.
                  • Providing or continuing the service became impossible. 

                  6. No guarantee of success

                  Visapath cannot guarantee a successful outcome of a visa application as the decision on visa applications is upon the Australian authorities. Even in the event of a positive decision on a visa application, cancellation of a granted visa by the responsible authorities is possible under certain legislative requirements.

                  7. Correctness, completeness and currency of information

                  7.1 The provision of this service is based on the information provided by the client. The client is responsible for the correctness and completeness of the information provided. It is the client’s obligation to provide complete and correct information and not to submit any false or misleading documents. It is a serious offense to provide false information or to submit false or forged documents as part of a visa application. 

                  7.2 It can be required to notify the relevant authorities of changes in circumstances during the assessment process. Therefore, the client must inform Visapath immediately if information or evidence provided by the client has changed between the time the client provided that information and a decision on an application for a visa is made.

                  8. Miscellaneous

                  8.1 The client consents to communication and the exchange of information and date electronically. The email address provided is the applicant's personal email address.

                  8.2 During preparation or assessment of an application for a visa, time frames and deadlines can apply (e.g. a request for more information by the Australian authorities with short timeframes to respond). Therefore, it is the obligation of the client to ensure availability by email at any time.

                  8.3 Visapath is using cloud-based software solutions and data storage. The client agrees that the ‘client file’, including data and documents provided by the client to Visapath, and other information related to the services for the client are stored in cloud-based computing systems. The client's data will be stored for 7 years after completion of the order in accordance with the legal requirements.

                  8.4 As a matter of internal policy Visapath handles client's data confidentially. Registered Migration Agents are obliged to maintain special confidentiality when handling client data. Although we are not bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988, we adhere to the underlying values contained in the APPs as a matter of internal policy and in complying with our obligations under the Registered Migration Agents Code of Conduct. 

                  8.5 This agreement conforms to the Code of Conduct, a copy of which is available from the Website of the Office of the Migration Agents Registration Authority (mara.gov.au).
