SERVICE AGREEMENT
Consultation regarding Australian visa and immigration matters
1. Parties to the contract:

2. Scope of service
2.1 Visapath will provide the following services:
The duration of the consultation is limited to the above-mentioned amount of time.
3. Professional fee
3.1 The fixed professional fee for the service listed in section 2 is .
3.2 The fee is due upon completion of the consultation.
3.3 Cancellation fees / Missed appointments:
a) If the client does not book an appointment using the booking link provided or cancels a booked appointment at least 24 hours in advance, no cancellation fee is payable.
b) If a booked appointment is cancelled less than 24 hours before the appointment or the client does not attend the booked appointment, is payable in full.
Cancellation fees are payable at the time of cancellation, at the latest after an unattended appointment.
3.4 We will reserve the amount of on your credit card or PayPal account (“Pre-Autorisation”), but will not finally charge it until the fee is due.
3.5 Visapath will perform the consultation only if the amount specified in clause 3.1 has been successfully pre-authorised on the selected means of payment. Visapath is not obliged to provide services according to section 2 if the agreed fee is not fully guaranteed by a valid reservation on the chosen payment method.
4. Appointment booking
4.1 After placing the order, Visapath will send the client a separate appointment booking link via email. This allows the client to select an appointment in the time slots provided by Visapath.
4.2 Booked appointments are binding. A one-time postponement is possible if Visapath is notified by email to support@visapath.com.au at least 24 hours before the booked appointment. Appointments can be postponed for no more than 2 weeks.
4.3 The agreed consulting time starts at the time booked by the client. If the client can only be reached late or if they log in late for an agreed video conference, the client is not entitled to a consultation duration extended by the delay.
5. Migration Agents and authorisation
5.1 The dedicated migration agents for services provided under this agreement are:

5.2 The client can contact Visapath and the migration agents responsible for submitting the application via email at support@visapath.com.au.
5.3 This agreement only covers immigration advice but not representation of the client in immigration matters.
6. Completion of service and termination of the contract
6.1 This service is completed with the the execution of the consultation according to section 2.
6.2 The order is furthermore completed if a booked appointment is not attended by the client at the selected time.
6.3 The client may cancel this agreement at any time. In this case, cancellation fees shall be due in accordance with section 3.2.
6.4 Termination of this agreement by Visapath is possible for the following reasons:
- The client has not booked a consultation appointment within 4 weeks of providing an appointment booking link.
- An irresolvable conflict of interest has arisen.
- Continuing the service is no longer reasonably possible for Visapath due to other reasons
7. Miscellaneous
7.1 The client consents to communication and the exchange of information and date electronically. The email address provided is the applicant's personal email address.
7.2 Visapath is using cloud-based software solutions and data storage. The client agrees that the ‘client file’, including data and documents provided by the client to Visapath, and other information related to the services for the client are stored in cloud-based computing systems. The client's data will be stored for 7 years after completion of the order in accordance with the legal requirements.
7.3 As a matter of internal policy Visapath handles client's data confidentially. Registered Migration Agents are obliged to maintain special confidentiality when handling client data. Although we are not bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988, we adhere to the underlying values contained in the APPs as a matter of internal policy and in complying with our obligations under the Registered Migration Agents Code of Conduct.
7.4 This agreement conforms to the Code of Conduct, a copy of which is available from the Website of the Office of the Migration Agents Registration Authority (mara.gov.au).
